Green Card Application

You should Know:

A visa or status with an expiration date is the nonimmigrant visa category. The visa category that gives you permanent resident status, which has not expiration date, is called immigrant visa status.

You can either can an immigrant visa from the consulate of your country or by adjusting your status from nonimmigrant to immigrant (permanent resident). The card issued to a permanent resident is popularly known as Green Card.

Someone who is in the U.S. on any visa status can adjust his/her status to permanent resident based on a job offer from a U.S. employer. There are five categories of Employment Based (EB) visa categories. Different individuals qualify for different category to seek Permanent Resident status based on own eligibility.

EB-1

A) Individuals with extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim.
• No offer of employment or labor certification is required.

B) Outstanding professors and researchers with international recognition for outstanding achievements in a particular academic field.
• No labor certification is required.

C) Individual who has offer of permanent employment from a U.S. employer Certain Multinational manager or executive who have been employed outside the United States for at least 1 year in the 3 years.
• No labor certification is required.

EB-2

A) Individual with a Master degree (from U.S. or an equivalent education from a foreign country) or

A) Individuals with a Bachelor degree (from U.S. or an equivalent education from a foreign country) plus minimum 5 years of progressive post-baccalaureate work experience in the specialty.

•  A Labor Certification is required for this process.

EB-3

A) Individuals who possess at least 2 years of job experience, education, or training that meets the job requirements specified on the labor certification.

B) Individuals with a Bachelor degree (from U.S. or an equivalent education from a foreign country)

C) An individual who can be classified as an unskilled labor (requiring less than 2 years training or experience) in the field of the offered job.

D) An individual who has a permanent job offer as a live-in household domestic service worker.

• Labor certification and a permanent, full-time job offer from a U.S. employer is required.
